Texas takes a different approach to ACOs as compared to the federal legislation on it. Senate Bill 7 is composed of multiple healthcare bills that failed to pass during the regular session of Congress. SB 8 is actually the specific law that enacts the Texas version of ACOs, which is a health care collaborative (HCC). This allows the same setup as an ACO, : a hospital, physicians, and other providers are able to obtain a license to practice in an integrated care setting. Negotiations on this portion of the law focused on anti-trust review and exemptions from fee-splitting that were some of the biggest concerns with ACOs at the federal level.
From a policy perspective, these bills were passed as part of a larger Omnibus bill within a special session that was called by then governor, Rick Perry.
